Analisis Peran Hukum Ekonomi Dalam Pencegahan Monopoli dan Persaingan Usaha Tidak Sehat di Indonesia

Abstract
This study analyzes the role of economic law in preventing such practices using a qualitative method, through in-depth interviews with lecturers, MSME (Micro, Small, and Medium Enterprises) practitioners, and students. The interviews with lecturers aim to understand economic law theories, while the interviews with MSME practitioners explore the impact of business competition, and the interviews with students assess their understanding of regulations. Data analysis uses a thematic method, with validity tested through source triangulation. The results of the study show that regulations such as Law No. 5 of 1999 have not been fully effective in preventing monopolies. MSMEs still struggle to compete with large companies due to limited capital, market access, and a lack of understanding of regulations. Therefore, there is a need for more concrete policy strengthening, enhanced oversight by the Business Competition Supervisory Commission (KPPU), and more intensive education for MSME practitioners regarding the existing regulations. This is crucial for creating healthier and fairer competition, which in turn will help improve the economic welfare of society, particularly for small business owners.
