Dampak UU ITE di Pariwisata Tentang Keterbatasan Kebebasan Berkomunikasi dalam Promosi Wisata

Abstract
This study aims to explore the impact of the Electronic Information and Transactions Law (ITE Law) on the freedom of communication in tourism promotion in Indonesia, particularly on digital platforms. The ITE Law, designed to protect the public from the misuse of information in cyberspace, is often perceived as a hindrance for tourism industry players in creating promotional content. This research uses a qualitative approach with in-depth interviews and documentary studies, involving tourism industry players and relevant legal experts. The findings show that the ITE Law creates legal uncertainty in interpreting several articles that are open to multiple interpretations, causing many industry players to feel restricted in their creativity and in expressing information transparently. The adaptive strategies implemented by industry players, such as using more neutral promotional visuals and videos, still have limitations in optimally attracting tourists. Furthermore, this regulation may affect the reputation of tourist destinations in the eyes of international tourists, particularly concerning perceptions of overly formal and less genuine content. This study recommends a revision of the ITE Law to better support creativity in tourism promotion, without compromising legal protection aspects.
